Bonito Hub Terms of Service

1. Introduction
1.1 These Terms of Service ("Terms") govern your access to and use of Bonito Hub, including the website located at hub.bonito.football and any related subdomains, features, content, and services operated by Insamlingsstiftelsen Bonito Foundation ("Bonito", "we", "us").
1.2 Bonito is a Swedish nonprofit organization with organization number 802482‑6136, focused on advancing football for social good globally. Our registered address and contact details are available on bonito.football.
1.3 By creating an Account, using Bonito Hub, or accessing the Bonito Community (as defined below), you agree to be bound by these Terms.
1.4 If you do not agree to these Terms, you may not use Bonito Hub.
2. Definitions
In these Terms:
- "Account" means a user account created on Bonito Hub using an email address.
- "Bonito Community" or "Community" means the online community for approved members hosted on a third‑party platform (currently Circle) and administered by Bonito.
- "Community Platform" means the third‑party community platform provider that Bonito currently uses to host the Bonito Community (at the date of these Terms, Circle Internet Services, Inc. at circle.so).
- "Community Minimum Age" means eighteen (18) years old.
- "Content" means any information, data, text, images, logos, links, documents, files, listings, events, or other material that is submitted, posted, uploaded, created, or otherwise made available on or through Bonito Hub or the Community.
- "Minimum Age" means sixteen (16) years old.
- "Organization" means any legal entity, project, initiative, or group that has or is assigned an organization profile on Bonito Hub, including (for example) nonprofits, clubs, league organizations, governing bodies or associations, player foundations, social enterprises, businesses active in the football industry, government or public‑sector bodies, educational institutions, and other football‑related initiatives.
- "Organization Member" means a user who has been granted a role (such as owner, admin, or member) linked to an Organization profile on Bonito Hub.
- "Organization-Submitted Content" means any Content on Bonito Hub that has been submitted, edited, claimed, or otherwise modified by users (whether as Organization Members or otherwise), as distinct from Content created and curated by Bonito's editorial team.
- "Services" means Bonito Hub, the Bonito Community, and related features, tools, and content provided by Bonito from time to time.
- "Service Provider" means a third‑party company that processes data on Bonito's behalf and under Bonito's control in order to provide the Services (for example, infrastructure and hosting providers, storage and content‑delivery networks, email and newsletter tools, analytics and error‑monitoring services, and customer‑support tools).
- "User", "you", or "your" means any person or organization that accesses or uses the Services.
3. Eligibility and Account Registration
3.1 Age requirement. You must be at least the Minimum Age to create an Account and use the Services. Age is confirmed during onboarding; you cannot complete account creation without confirming that you meet this requirement.
3.2 Professional context. Bonito Hub is intended primarily for people and organizations working in, or closely connected to, football for social development and football coaching. While any eligible person may create an Account, some features (including the Community) are restricted to users who meet additional professional criteria. Bonito Hub is not designed to be used by children as participants in programs or as unsupervised volunteers in activities involving children or other vulnerable individuals.
3.3 Account creation. To create an Account, you must provide a valid email address and complete the sign‑in flow. An Account is created when you complete sign‑in and onboarding, including providing your full name and confirming that you meet the Minimum Age. You must provide accurate information and keep it up to date.
3.4 One person per Account. Your Account is personal to you. You may not share your Account or allow others to access the Services using your credentials.
3.5 Security. You are responsible for maintaining the confidentiality of any login links or authentication methods associated with your Account and for all activities that occur under your Account. You must notify Bonito promptly if you become aware of any unauthorized access to or use of your Account.
4. Bonito Hub Services
4.1 Bonito Hub currently provides, among other things:
- A global directory of Organizations working in or connected to football for good, including public profiles with descriptive and classification information.
- Organization membership and claiming workflows, allowing individuals to be linked to Organizations and to hold different roles.
- Organization-published materials such as case studies, reports, research, photos, event listings, and similar resources.
- An invitation‑only Community for eligible members, hosted on a third‑party platform.
Bonito Hub is designed to highlight the people and Organizations using football as a force for good, including stories, photos, case studies, and other materials that Organizations choose to share.
4.2 The Services may evolve over time. Bonito may add, modify, or remove features. Where reasonably practicable, Bonito will provide reasonable advance notice of material changes (see Section 13).
4.3 Nothing in the Services constitutes legal, financial, employment, or other professional advice. You are responsible for your own decisions and due diligence when using information found through the Services.
4.4 Football focus and sector scope. Bonito Hub is dedicated to Organizations and people working in or through football. To create or maintain an Organization profile, the Organization must have a genuine and material connection to football (for example, as a club, league, governing body, program, social enterprise, or business working in the football ecosystem). Bonito welcomes a wide range of football‑related Organizations, including commercial actors, but may remove or refuse Organization profiles that, in its reasonable judgment, are not sufficiently related to football.
5. Organization Profiles and Organization Members
5.1 Sources of Organization profiles. Organization profiles on Bonito Hub may be:
- Created by Bonito — based on publicly available information, to reflect Organizations active in the football-for-good ecosystem, whether or not those Organizations have engaged with Bonito Hub directly. Bonito's curation is part of its mission to map and support the ecosystem.
- Created by users — by users acting on behalf of an Organization, or by Bonito staff in response to a request from an Organization.
Any Organization profile, regardless of how it was created, may subsequently be claimed by an authorized representative of the Organization through Bonito's claim process (see Section 5.6). A claimed profile remains the same Organization profile, but is then maintained by the claimer in cooperation with Bonito.
Bonito may review, edit, approve, reject, or remove Organization profiles at its discretion. Where users submit, edit, or claim a profile, the resulting information is treated as Organization-Submitted Content. The representations in Section 5.4 apply only to users who create or claim Organization profiles, not to profiles in a purely Bonito-curated, unclaimed state.
5.2 Organization types. When creating or managing an Organization profile, you must select the most appropriate Organization type from the options provided (for example, nonprofit, club, league organization, governing body or association, player foundation, social enterprise, business, government/public sector, educational institution, or other). If you select "other", you must accurately describe the nature of the Organization or group. Bonito may edit the type or description, or ask you to change it, to better reflect how the Organization fits into the football ecosystem.
5.3 Social enterprises and businesses. Social enterprises and businesses that work in or support the football ecosystem are an important part of Bonito Hub and are welcome to create Organization profiles.
5.4 Representation. If you create, claim, or manage an Organization profile, you represent and warrant that:
- You are authorized to act on behalf of that Organization; and
- The information you provide is accurate and not misleading.
5.5 Organization roles. Bonito Hub supports different roles for Organization Members (for example, owner, admin, member). These roles have different permissions in the product. Bonito may modify role types and permissions at any time.
5.6 Claiming Organizations. If you request to claim an Organization profile, Bonito may require additional verification (including LinkedIn verification, verification documents, and, in some cases, email correspondence to confirm authority) and may approve or reject the claim at its sole discretion.
5.7 Public nature of Organization data. Organization profiles are intended to be public directory entries. Information you submit for an Organization profile (for example, description, mission, contact details, website, and donation links, and classifications) may be visible publicly on Bonito Hub and may be used in Bonito's communications, research, and ecosystem mapping, as described in Section 7.
5.8 Editorial discretion and mission alignment. Bonito curates the Organizations and Content that appear on Bonito Hub to advance its mission. Bonito may decline, edit, or remove Organization profiles or other Content, or limit access to certain features, even where they comply with the letter of these Terms, where Bonito reasonably believes that doing so is appropriate based on factors such as alignment with Bonito's mission and values, safeguarding and child‑protection concerns, applicable sanctions or legal restrictions, reputational risk, or other editorial judgment. These decisions are subject to Bonito's complaints process (see Section 8.5).
5.9 Claim, correction, and removal requests. If your Organization appears on Bonito Hub and you wish to claim it, you may do so through Bonito Hub's claim process (see Section 5.6).
If you wish to correct information about an Organization that you have not claimed, Bonito will normally ask you to claim the profile first so that an authorized representative can make the changes. Where claiming is not possible or is declined, Bonito may correct information at its discretion based on the information you provide.
If you request that an Organization no longer be visible on Bonito Hub:
- Bonito will withdraw the Organization profile from public view on Bonito Hub.
- Where the profile has been claimed, and an authorized representative has submitted personal data about themselves or other individuals, Bonito will delete that user-submitted personal data upon request, in accordance with applicable data protection law.
- Bonito may retain the underlying organization-level data (such as name, website, founded year, operating countries, and similar publicly available information) in its internal records for the purposes of its work mapping the football-for-good ecosystem, including journalistic and editorial activity on bonito.football.
Requests under this Section may be sent to legal@bonito.football. The complaints process and response timelines in Section 8.5 apply.
6. LinkedIn Verification and Additional Profile Data
6.1 LinkedIn verification. Bonito Hub offers an optional LinkedIn verification flow. Certain features (including creating or claiming Organization profiles and access to the Community) require successful completion of LinkedIn verification.
6.2 Collected data. When you choose to verify via LinkedIn, Bonito collects and stores information made available by LinkedIn — your verified name, profile picture, LinkedIn profile URL, and email address. Bonito uses this data solely to support identity and role verification, fraud prevention, and trust in the Services. Further details are provided in Bonito's Privacy Policy.
6.3 Additional profile data. During onboarding and later editing, you may provide additional information such as a headline, location, Organization affiliation, and football‑related profile fields. Some features (including participation in the Community) are only available if you have provided certain additional data.
6.4 Verification limitations. LinkedIn verification and additional profile data help Bonito assess the credibility of Accounts, but they are not guarantees of identity or professional status. Bonito does not undertake to independently verify all information and does not warrant that verified users or Organizations are who they claim to be.
7. User Content and Intellectual Property
7.1 You own your Content. You retain any rights you have in Content you submit or upload to the Services, including profile information, Organization data, listing text, images, documents, case studies, reports, research outputs, and other materials.
7.2 License to Bonito. By submitting or making Content available through the Services, you grant Bonito a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, adapt, translate, analyze, index, and create derivative works from that Content solely in order to:
- operate, maintain, and protect Bonito Hub and other online services operated by Bonito;
- provide, improve, and develop features (including search, recommendations, and AI‑powered tools such as summarisation, matching, and discovery);
- communicate about the Services and about Organizations and programs featured on them (for example, in newsletters, social media, case studies, and reports); and
- carry out Bonito's research, storytelling, and ecosystem‑mapping activities related to football for good.
For Content that clearly depicts identifiable individuals, and in particular children or other vulnerable individuals, Bonito will normally only use such Content in Bonito‑authored public communications outside the Services (for example, standalone case studies, campaign pages, or fundraising materials on bonito.football) where the uploading Organization has separately confirmed that it has the right to authorize that specific use. This does not limit Bonito's ability to display such Content within the Services themselves, such as on Organization profiles or in other directory views.
7.3 Service providers, not sub‑licensing. Bonito may allow its trusted Service Providers to process your Content strictly on Bonito's behalf and under written contracts that require them to follow Bonito's instructions and protect your data. This does not give those providers any independent right to use your Content for their own purposes (for example, to train their own models or build separate products). The categories and identities of Bonito's Service Providers are set out in Bonito's Privacy Policy.
7.4 No sale or stand‑alone licensing of your Content. Bonito will not sell your Content or license it as a stand‑alone dataset to third parties, and will not permit third parties to use your Content to train their own general‑purpose AI models or other services unrelated to Bonito's products.
7.5 Duration of license and retention. This license continues for as long as your Content is available on the Services and for a reasonable period afterward to allow Bonito to:
- maintain technical and security logs and backups;
- keep copies already incorporated in newsletters, reports, research outputs, or other communications created in good faith; and
- comply with legal or regulatory obligations, including Swedish media law and archiving rules that require Bonito to retain published material for a minimum period. In particular, Content republished by Bonito on bonito.football is covered by a Swedish publishing certificate (utgivningsbevis) and is subject to retention obligations under yttrandefrihetsgrundlagen. Details are set out in Bonito's Privacy Policy and at bonito.football/utgivningsbevis.
Where an Organization informs Bonito that consent for the use of specific images of identifiable individuals has been withdrawn, Bonito will stop using those images in new public communications and will, where reasonably practicable, remove them from online channels under Bonito's control, but is not required to recall or amend materials that have already been sent, printed, or lawfully archived.
Bonito may also receive consent-withdrawal or removal requests directly from depicted individuals, their parents or guardians, or other rightsholders. Bonito will assess such requests under its Child Safeguarding Policy where they involve children or vulnerable individuals, and otherwise under applicable data-protection law. The operational outcome is the same as above: Bonito will stop using the affected Content in new public communications and will, where reasonably practicable, remove it from online channels under Bonito's control.
Removing Content from your profile or Organization, or deleting your Account, does not require Bonito to automatically remove or destroy such archival copies, but Bonito will not continue to use your Content for new public communications or new model‑training runs after deletion or Account closure, except where retention or further use is required by law or would involve disproportionate effort.
7.6 Bonito's content. Bonito and its licensors own all rights in and to the Services and related materials, including but not limited to the software, design systems, data models, taxonomies, classifications, curated Organization data created by Bonito, and Bonito's trademarks and logos. Except for the limited rights expressly granted in these Terms, no rights are granted to you, whether by implication, estoppel, or otherwise.
7.7 Restrictions on use of Bonito content. You may not, without Bonito's prior written consent:
- copy, scrape, harvest, or bulk‑download significant portions of the directory, Organization listings, or other curated data on the Services;
- redistribute, resell, or otherwise commercially exploit Bonito's curated data, taxonomies, classifications, or other database content;
- create derivative works from Bonito's curated data, or use it to train artificial intelligence models or to build competing products or services;
- use any automated means (including robots, spiders, crawlers, or large-language-model agents) to access the Services in a manner that could harm performance, circumvent access controls, or extract significant portions of Bonito's content; or
- use Bonito's trademarks, logos, or branding in a way that suggests endorsement, sponsorship, or affiliation without Bonito's prior written permission.
7.8 Third‑party rights and images of people. You must ensure that you have all necessary rights to the Content you provide and that your Content does not infringe any third‑party rights, including copyright, trademarks, privacy, or personality rights. In particular, you are responsible for making sure you have an appropriate legal basis (for example, consent where required) before uploading photos, videos, or stories that identify children or other individuals in your programs.
8. Acceptable Use
8.1 You agree that your use of the Services and any Content you submit will not:
- be unlawful, fraudulent, or otherwise prohibited by these Terms;
- be harassing, defamatory, discriminatory, hateful, threatening, or otherwise harmful to others;
- promote or link to extremist, violent, or abusive content;
- misrepresent your identity, qualifications, or affiliation with any person or Organization;
- create or maintain an Organization profile that is misleading about the Organization's connection to football or its type, or that Bonito reasonably believes does not belong on a football‑focused platform;
- upload highly sensitive or confidential information (including special‑category personal data) that you or others would reasonably expect to remain private, as the Services are designed for public or professional‑context information;
- involve sending unsolicited or bulk communications (spam), or harvesting email addresses or other contact details from the Services for marketing or recruitment without consent;
- distribute or upload viruses, malware, or other harmful code;
- infringe intellectual property or other rights of Bonito or any third party;
- attempt to gain unauthorized access to any part of the Services or related systems; or
- interfere with or disrupt the normal operation of the Services or the experience of other users.
8.2 The Services are not intended for political campaigning, party‑political advertising, or activities that conflict with Bonito's mission and values. Bonito may remove or restrict access to Content or Accounts that, in its sole judgment, undermine the integrity or safety of the network.
8.3 Organization responsibilities. Organizations using the Services remain responsible for complying with applicable laws and standards related to safeguarding, child protection, labor, anti‑corruption, and non‑discrimination in the jurisdictions where they operate. This includes independently assessing eligibility, supervision, and safeguarding requirements when accepting applications or volunteers through the Services, particularly where those volunteers are under 18 or will work with children or other vulnerable individuals.
8.4 Safeguarding and images of children. Many Organizations that use the Services work with children and young people. When you upload or share Content that includes or describes children or other vulnerable individuals, you must:
- ensure you have an appropriate legal basis and any required consents under the laws that apply to you;
- avoid publishing information that could put anyone at risk (for example, detailed contact information, exact locations, or sensitive case details); and
- present people in ways that respect their dignity and safety.
Bonito may remove or restrict access to Content, or take other action, if it believes that Content involving children or other vulnerable individuals is unsafe, unlawful, or inconsistent with good safeguarding practice. Safeguarding concerns should be directed to safeguarding@bonito.football under Bonito's Child Safeguarding Policy. If a child is in immediate danger, contact local emergency services first.
By uploading Content that depicts or describes identifiable children or other vulnerable individuals, the Organization represents and warrants that, at the time of upload: (a) it has obtained all consents and approvals required under applicable data-protection, child-protection, and image-rights laws in the jurisdictions where the depicted individuals are located; (b) it has the legal authority to grant Bonito the licenses set out in Section 7.2 with respect to that Content; and (c) the consents obtained extend to Bonito's intended uses of the Content as described in these Terms and in Bonito's Privacy Policy. The Organization will promptly notify Bonito at safeguarding@bonito.football if any of those consents are withdrawn or if the Content otherwise becomes problematic to display.
8.5 Reporting Content and Complaints Process. If you believe that Content on the Services infringes your rights (for example, copyright, privacy, or image rights) or otherwise violates these Terms, you can report it by contacting Bonito at abuse@bonito.football and providing:
- the URL or other information that allows Bonito to identify the Content;
- a brief explanation of what you believe is wrong with the Content; and
- your name and contact details.
Bonito will acknowledge reports within seven (7) days and respond substantively within thirty (30) days, where reasonably practicable. We may remove or restrict access to Content, or take other action, in line with these Terms and applicable law. Where Bonito restricts access to Content or an Account, Bonito will normally inform the affected User of the main reasons for the decision, unless Bonito is prevented from doing so by law or by important security considerations.
The same process applies to complaints about editorial decisions (Section 5.8), Community moderation (Section 10.7), or other Bonito actions affecting your use of the Services.
9. Organizations and External Relationships
9.1 No endorsement or vetting. Inclusion of an Organization or Content on the Services does not constitute Bonito's endorsement, certification, or verification of that Organization, its programs, or its practices. Bonito does not routinely vet Organizations, staff, or information on the Services and does not guarantee that such information is accurate, complete, or up to date.
9.2 "Verified" badge. Some Organization profiles may display a "Verified" or similar badge. This badge indicates that an Organization representative has claimed the profile, provided verifications about themselves and the Organization, and that Bonito has accepted the claim after a manual review (which may include email correspondence to confirm authority). It does not mean that Bonito has audited or approved the Organization's governance, safeguarding, finances, impact, or compliance, nor does it warrant that the claimer has actual authority to act on behalf of the Organization. You should always carry out your own checks before working with any Organization, whether or not it has such a badge.
9.3 No party to agreements. Any employment, volunteering, donation, sponsorship, or other agreements formed between users and Organizations (or between Organizations) as a result of use of the Services are solely between those parties. Bonito is not a party to such agreements and has no responsibility or liability for their performance.
9.4 User responsibility. You are solely responsible for carrying out your own due diligence before entering into any relationship or transaction with Organizations or individuals found through the Services, particularly where work involves children or vulnerable adults.
10. Bonito Community
10.1 Nature of the Community. The Bonito Community is an online space operated by Bonito and hosted on the Community Platform, intended for people working in football for good and for football coaches who meet Bonito's eligibility criteria.
10.2 Eligibility. To apply for membership in the Community, you must, at a minimum:
- hold an active Account on Bonito Hub;
- be at least the Community Minimum Age (18 years);
- have completed LinkedIn verification; and
- have provided additional profile information requested by Bonito (including, for example, your headline, location, Organization, and football profile).
Bonito may set additional or more specific criteria from time to time.
10.3 Application and approval. Community membership is not automatic. You must apply or be invited, and Bonito may approve or reject any application, or remove or suspend any Community member, at its sole discretion.
10.4 Additional terms and guidelines. Participation in the Community is subject to:
- these Terms;
- Bonito's separate Community Guidelines or Community Terms, as updated from time to time; and
- The Community Platform's own Terms of Service and Privacy Policy.
By joining or using the Community, you agree to all of the above.
10.5 Use of Community Platform. The Community is hosted on the Community Platform. When you join, certain personal data about you (for example, your name, email address, profile information, and Organization) will be shared with the Community Platform to enable the Community to operate. The Community Platform processes some of this personal data for its own purposes under its own terms and privacy notices, and may act as an independent data controller for those activities. Bonito remains responsible for the decision to share data with the Community Platform and for its own use of that data, as described in Bonito's Privacy Policy.
10.6 Relationship with the Community Platform. The Community Platform operates its own platform and services and provides its own terms and privacy notices. You may be required to accept the Community Platform's terms within the Community Platform interface. Bonito is not responsible for the Community Platform's availability, performance, or handling of your data under the Community Platform's own policies.
10.7 Moderation. Bonito may moderate the Community, including by editing, moving, or removing posts; issuing warnings; temporarily or permanently suspending Community access; or taking other actions it considers appropriate to maintain a safe and constructive environment. Bonito may take these actions at any time, with or without notice. Complaints about moderation decisions may be raised under Section 8.5.
10.8 No entitlement. Having an Account on Bonito Hub does not entitle you to access or remain in the Community. Access to the Community is a discretionary feature that Bonito may limit, suspend, or discontinue at any time.
11. Privacy and Data Protection
11.1 Bonito's handling of personal data is described in its separate Privacy Policy available at https://bonito.football/privacy-policy. Bonito acts as the data controller for personal data processed in connection with Bonito Hub and, together with the Community Platform, as a joint or independent controller for certain Community‑related processing, as described in the Privacy Policy.
11.2 By using the Services, you acknowledge that Bonito will process your personal data as described in the Privacy Policy. You should read the Privacy Policy carefully before using the Services.
11.3 Among other things, the Privacy Policy explains:
- what personal data Bonito collects about you and Organizations;
- how and for what purposes that data is used, including any AI processing;
- the legal bases for processing under the GDPR;
- which third‑party providers process data on Bonito's behalf;
- how long data is retained;
- how personal data may be transferred outside the EU/EEA and what safeguards apply;
- your rights under applicable data‑protection laws, including rights to access, rectify, and delete personal data, and the right to lodge a complaint with the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, IMY); and
- how to contact Bonito regarding privacy matters.
11.4 Editorial publishing and the publishing certificate. Where Content from Bonito Hub is republished by Bonito on bonito.football, it may fall within the scope of Bonito's Swedish publishing certificate (utgivningsbevis) under yttrandefrihetsgrundlagen. In that case, Swedish constitutional media law may limit certain GDPR rights, including the right to erasure, with respect to the republished content. This is explained in the Privacy Policy and at bonito.football/utgivningsbevis.
12. Third‑Party Services and Links
12.1 The Services may contain links to websites or services operated by third parties, including Organization websites, donation pages, social media profiles, newsletter sign‑up forms, recruitment systems, and the Community Platform.
12.2 Bonito does not control and is not responsible for third‑party websites, services, or content. Links are provided for convenience and do not imply endorsement or responsibility.
12.3 Your use of third‑party websites and services is governed by their own terms and privacy policies, not by these Terms. You are responsible for reviewing and complying with those terms.
13. Changes to the Services
13.1 Bonito may modify, suspend, or discontinue any part of the Services at any time.
13.2 Bonito will endeavor to avoid changes that materially and adversely affect users without good reason. Where reasonably practicable, Bonito will provide reasonable advance notice of material changes, for example, by email or by displaying a prominent notice in the Services.
14. Suspension and Termination
14.1 Your right to stop using the Services. You may stop using the Services at any time. You may also delete your Account using the tools provided in the user interface. Deletion and its effects on your data are described in the Privacy Policy.
14.2 Bonito's rights. Bonito may, at any time and without liability to you, restrict, suspend, or terminate your Account or your access to some or all of the Services (including the Community) if:
- you breach these Terms or any applicable law;
- Bonito reasonably believes your use of the Services may cause harm to others, to Bonito, or to the integrity or security of the Services;
- Bonito is required to do so by law or by a competent authority; or
- Bonito ceases to provide the Services in whole or in part.
14.3 Effect of termination. Upon termination of your Account or access to the Services:
- your right to use the affected Services will immediately cease;
- Bonito will anonymize your personal Account data as described in the Privacy Policy. Certain non‑identifying records may be retained for security, legal, and statistical purposes;
- Content you or your Organization has submitted may continue to be used and retained as described in Section 7 — for example, where it forms part of Organization profiles, newsletters, reports, or lawful archives — but Bonito will not use your Content in new public communications after closure, except where retention or further use is required by law or would involve disproportionate effort;
- where Content has been republished by Bonito on bonito.football under its Swedish publishing certificate (utgivningsbevis), that republished material may be retained as required by Swedish media law, independent of any deletion of your Account on Bonito Hub. The Privacy Policy explains how this affects your rights; and
- the provisions of these Terms that by their nature should survive termination — including Sections 7, 8, 9, 11–18 — will continue to apply.
15. Disclaimers
15.1 The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Bonito makes no warranties, express or implied, about the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, non‑infringement, or that the Services will be uninterrupted, error‑free, secure, or free of harmful components.
15.2 No verification of Content; due diligence required. Bonito does not warrant the accuracy, completeness, or timeliness of any Content on the Services, including information about Organizations, their programs, contact details, social media accounts, operating countries, classifications, or affiliations. You must independently verify information before making decisions based on it, particularly decisions involving funding, partnership, employment, volunteering, donations, or work with children or other vulnerable individuals. You use the Services and rely on any information at your own risk.
15.3 Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded or limited under mandatory law.
15.4 Force majeure. Bonito shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by circumstances beyond Bonito's reasonable control, including (without limitation) acts of God, natural disasters, war, terrorism, civil unrest, public health emergencies, pandemics, fire, flood, infrastructure failures, internet outages, denial-of-service or other cyber attacks, action by government or regulators, or failures of third-party Service Providers. Bonito will take reasonable steps to mitigate the effects of such events and, where practicable, restore the Services.
16. Limitation of Liability
16.1 To the fullest extent permitted by law, Bonito shall not be liable for:
- any indirect, incidental, special, consequential, or punitive damages;
- any loss of profits, revenue, business, goodwill, or data; or
- any damages resulting from (i) your use of or inability to use the Services; (ii) any conduct or Content of any third party on the Services; or (iii) unauthorized access to, use of, or alteration of your transmissions or Content.
16.2 To the fullest extent permitted by law, Bonito's total aggregate liability arising out of or relating to the Services or these Terms, whether in contract, tort (including negligence), or otherwise, shall be limited to the greater of:
- the amount (if any) you have paid to Bonito for use of the Services during the twelve (12) months immediately preceding the event giving rise to the claim; and
- one hundred (100) euros (€100) per claim.
16.3 The limitations in this Section do not apply to liability resulting from Bonito's intent or gross negligence, personal injury, or other liability that cannot be limited under mandatory law.
17. Indemnity by Organizations
17.1 To the fullest extent permitted by law, each Organization agrees to indemnify and hold harmless Bonito, its trustees, employees, and agents from and against any third‑party claims, demands, actions, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Content that the Organization or its Organization Members submit, upload, or make available through the Services (including alleged infringement of intellectual‑property, privacy, or personality rights, or safeguarding and child‑protection concerns); or
- The Organization's use of the Services in breach of these Terms or of applicable law.
17.2 This indemnity applies only to Organizations (including their authorized representatives and Organization Members acting on their behalf) and does not create any additional obligations for individual Users acting purely in a personal capacity.
18. Governing Law and Disputes
18.1 These Terms and any dispute or claim arising out of or in connection with them or with the Services shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict‑of‑law principles.
18.2 The courts of Sweden shall have non‑exclusive jurisdiction over any such dispute or claim. If you are a consumer residing in the EU or EEA, you may also have the right to bring proceedings in your country of residence under mandatory consumer‑protection laws.
18.3 Before initiating formal legal proceedings, you are encouraged (but not required) to contact Bonito to seek an informal resolution, including via the complaints process described in Section 8.5.
18.4 Supervisory authority information. Bonito is an insamlingsstiftelse (charitable foundation) subject to supervision by the relevant County Administrative Board of Stockholm (Länsstyrelsen Stockholm) in Sweden in accordance with the Swedish Stiftelselagen (1994:1220). For data‑protection matters, the supervisory authority is the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, IMY). For matters relating to content published on bonito.football under the publishing certificate, the supervisory authority is the Swedish Media Authority (Mediemyndigheten). This information is provided for transparency and does not give you any additional contractual rights or remedies beyond those set out in these Terms or under mandatory law.
19. Changes to these Terms
19.1 Bonito may update these Terms from time to time. When changes are made, Bonito will post the updated Terms on Bonito Hub and update the "Last updated" date at the top.
19.2 If changes are material, Bonito will take reasonable steps to notify you, for example, by email or by displaying a prominent notice in the Services. Where required by law, Bonito will ask for your consent to material changes.
19.3 Your continued use of the Services after the updated Terms have become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services.
